This is a very difficult problem that occurs all across Bulgaria, there is another side to this and its about the people who had these apts built to sell at huge profits. The building owners who take 15 euro a meter and do not spend it on the upkeep of the building but pocket it for their salaries and their living standards. When people complain they sell the maintenance contract for the building and walk away. I think a service charge of 100 lev per year is a very good price to pay as for changing locks to stop people using their apts is illegal also issuing a swipe card for the lift is illegal for safety reasons ie fire emergency all people need a way of exiting the building,also there has to be lighting on (all floors).This is a difficult situation you stated that no one has been issued a contract for maintenance you say you have a management team who set the annual cost if this is not signed for ie contract then their is no legal come back for people who do not pay.The owners of the apts do not own the swimming pool and outside space then the upkeep has to be done by the people who do own them and agree a payment plan for residents.A contract needs to be drawn up for all the owners describing what they are paying for agree it and sign it. 8)

You are advised NOT to use the lift if there is a fire alarm, otherwise you are correct on each and every point, no contract no pay.

Amadeus 3 is just one of the many Amadeus's that have been built by this company, it would be interesting to see if any of the other complex's have the same problem. Having been to the complex today the pool is now green, and still no lifts.

There is a meeting tonight at 18.30 with the management company to discuss what is going to happen, Strange how they arrange it once everyone has gone home ???

Questions that need to be asked

1. Who voted the management company in

2. Where are the minutes of the AGM from every year, Why were people not informed of the AGM

3. Accounts on how money has been spent

I feel that until these have been answered, there is no way forward.

Answers to the questions

1. The management company were involved in the building of the complex and once it was completed in 2006 they took responsibility for the maintenance.
2. Have never known of an AGM taking place and never received a minute of any meetings that have taken place.
3. No accounts have ever been distributed or discussed with owners in this conplex.

This is because they are only interested in selling apartments any after sales agreement is a lie and they will do anything to sell. Having a meeting of all owners is a thing they do not want.They do not want an agm they just want you to give them money with no questions asked . They will not discuss accounts with you because they are taking money for so called maintenance and spending it on their own life style the only way to get round this is to have a trusty maintenance company who will not steal your money.This is a difficult situation.

One of the problems is that you have to get a majority of owners to agree to the new company taking over. We have been approached by complex's but the problem is they cant find out who owns what apartment, so that they can get a new company in.

I can tell you that you will need 51 per cent of the owners to agree also are there any apts left to sell if the answer is yes then the builders could have a majority of 51 percent if this is the case then they have control of the maintenance company and then they do not have to listen to your request. Can I ask how do you the owners pay the water bill for their apt does the local water company read the meters or is it the management company. 8)
